How informed are you in changes to IMDG Code ?

IMDG Code, the mandatory instrument under SOLAS and MARPOL conventions of International Maritime Organisation for carriage of dangerous goods in packaged form by sea, undergoes biennial revisions. The latest amendment is 36th amendment published in 2012. With amendment number and year of publication this edition is called as IMDG Code 36-12.

IMDG Code 36-12 came into voluntary usage from 1st January 2013 and will come into force from 1st January 2014. Click here to see IMDG Code Amendment cycle 2010-2019.

IMDG Code 36th amendment (36-12) brought out many revisions and additions including total reshuffling of provisions concerning transport operations in chapter 7.x. Click here to see changes to IMDG Code 36-12 or search ’36-12′ in search box on top right hand side of this page.

October 2014 new IMDG Code will be published which will come into voluntary and mandatory application from 1st Jan 2015 & 1st Jan 2016 respectively.  This edition will be called as 37-14.

Time flies by before we realize seasons changing. Similarly regulations for transport of dangerous goods by sea continuously gets revised and modified. If we do not keep up with regulatory changes we will fall short on compliance which may pose risk to personnel and property or environment with deadly consequences.

IMDG Code 37th amendment (37-14) is about to bring out revolutionary revisions in stowage and segregation requirements by replacing stowage segregation rules by codes and various other changes including but not limited to tank  hazard communications, marine pollutant communications, vehicle shipments clarifications and exemptions etc.

Training is the first step to Compliance and Safety. Timeline for training for dangerous goods by sea is as below;

  • From 1st January 2008 – Recommendatory
  • From 1st January 2010 – Mandatory

Since training became mandatory in 35th amendment of IMDG Code (34-08) four years have passed. There are still a great lot of personnel in shore side who are either not trained or not undertaken mandatory refresher training.

It is the organization’s responsibility to ensure all personnel are trained commensurate with their responsibilities and timely refresher training is provided. Training can be provided either as classroom training, in house training or eLearning. The requirement of IMDG Code is ‘you SHALL  be trained to handle dangerous goods’.

To which types of ships IMDG Code is applicable

IMDG Code is applicable to any to ship which SOLAS 74, as amended, applies and are carrying dangerous goods. Dangerous Goods is defined in Regulation 1 of SOLAS Chapter VII Part A as the substances, materials and articles covered by the IMDG Code.

 Document of compliance with the special requirements for ships carrying dangerous goods as per the provisions of regulation II-2/19 of the SOLAS 1974, as amended is applicable to

 a)    Passenger ships and Cargo ships constructed on or after 1st July 2002

 b)   1. For passenger ships constructed on or after 1st Sept 1984 but before 1st July 2002

 2. a cargo ship of 500 gross tons or over constructed on or after 1st Sept 1984 but before 1st July 2002

 3. a cargo ships of less than 500 gross tons constructed on or after 1st Feb 1992 but before 1st July 2002

 the requirements of regulation II-2/54 of SOLAS 1974, as amended by MSC.1(XLV), MSC.6(48), MSC.13(57), MSC.22(59), MSC.24(60), MSC.27(61), MSC.31(63) and MSC.57(67), apply.

 Member governments to SOLAS Convention is recommended to apply, as far as possible, IMDG Code to cargo ships of less than 500 gross tons constructed on or after 1st Sept 1984 and before 1st Feb 1992.

 Any ship irrespective of size and type which carries substances, materials or articles identified as Marine Pollutants in IMDG Code are subject to the provisions of the said code.

IMDG Code, 2012, may be applied from 1 January 2013 on a voluntary basis and will come in force on 1 January 2014 without any transitional period. The Code is officially published by International Maritime Organization (IMO) and is available to purchase.

Aluminium Phosphide Explosion on Maersk Kinloss

During cargo operations at Ilyichevsk, Ukraine, on 17th July 2012 dock workers noticed a container in hold with obvious signs of damages suffered by explosion. The said container was carrying aluminium phosphide.

Aluminium Phosphide is listed in IMDG Code as UN 1397, ALUMINIUM PHOSPHIDE, Class 4.3/6.1. Observation states “Reacts with acids or decomposes slowly in contact with water or damp air, evolving phosphine, a spontaneously flammable and highly toxic gas. Stowage requirement of this cargo is Category E. Under deck in a mechanically ventilated space. Clear of living quarters.

Aluminium Phosphide is widely used as rodenticide, insecticide, and as fumigant. Aluminium phosphide pellets mixed with food is kept for rodents, once inside their stomach this chemical will react with gastric acids and generate phosphine a highly toxic and flammable gas.

Aluminium phosphide pesticide is classified under UN 3048 Class 6.1 which does not have the tendency of class 4.3.

In Indian subcontinent  there is a large proportion of poisoning by aluminium phosphide. The overall mortality rate found in the study “Incidence & outcome of aluminium phosphide poisoning in a hospital study” by Department of Medicine, Medical College & Hospital, Rohtak, India, is 77.2 per cent.

MARINE POLLUTANTS

IMDG Code identifies a substance, material or article as MARINE POLLUTANT with the criteria based on those developed by the United Nations Globally Harmonized System of Classification and Labelling of Chemicals (GHS), as amended. This criteria is listed in Appendix to Annex III of MARPOL.

Marine pollutants are identified with letter “P” in column 4 of dangerous goods list in chapter 3.2

MARPOL Annex III deals with ‘Regulations for the Prevention of Pollution by Harmful Substances Carried by Sea in Packaged Form’. This regulation deals with Application, Packing, Marking and labelling, Documentation, Stowage, Quantity limitations, Exceptions & Port State control on operational requirements. In this article we will look at Annex III requirement for, Marking and labelling and Documentation; regulations 3 & 4 respectively.

Marking and labelling

Every package containing marine pollutant shall be marked with correct technical name and marine pollutant mark. These marks and label shall be so durable that information will still be identifiable on packages surviving at least three months’ immersion in the sea.

Dimensions at least 100 mm × 100 mm

Exception: for packages, single packagings and inner packagings of combination packagings containing

– a net quantity of 5 l or less for liquids; or a net mass of 5 kg or less for solids.

Documentation

If the cargo is a marine pollutant Dangerous Goods Declaration must indicate this with words ““MARINE POLLUTANT”. Also if the cargo is under a generic or N.O.S. entry then proper shipping name shall be supplemented with technical name.

Amendment to SOLAS chapter VII – Regulation 4

At 90thsession held from 16 to 25 May 2012 Maritime Safety Committee (MSC) adopted amendment to SOLAS chapter VII – Regulation 4. The new text will replace the existing text and will come in force from 1 January 2014.

New text is as below

Regulation 4 –   Documentation

 1 Transport information relating to the carriage of dangerous goods in packaged form and the container/vehicle packing certificate shall be in accordance with the relevant provisions of the IMDG Code and shall be made available to the person or organization designated by the port State authority.

2 Each ship carrying dangerous goods in packaged form shall have a special list, manifest or stowage

plan setting forth, in accordance with the relevant provisions of the IMDG Code, the dangerous goods on board and the location thereof. A copy of one of these documents shall be made available before departure to the person or organization designated by the port State authority.

Regulation 4 is envisaged entry-into-force date of 1 January 2014, in order to align the entry-into-force date of the aforementioned SOLAS amendments with that of the amendments to the IMDG Code scheduled to be adopted in 2012

World Oceans Day & MARPOL ANNEX III

June 08th is observed as World Oceans Day. 2011 & 2012 theme is Youth: the Next Wave for Change.

On this occasion let us look at Annex III of International Convention for the Prevention of Pollution from Ships, 1973/78.

Annex III of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto (MARPOL 73/78), deals with the prevention of pollution by harmful substances carried by sea in packaged form.

Annex III of MARPOL has 8 regulations, below are the explanation of each.

1.       Application

This regulation identifies harmful substances as those identified as marine pollutant by IMDG Code or any substance which meets the criteria laid down in appendix to annex III.

Packaged form means the forms of containment specified for harmful substances in the IMDG Code.

It further states carriage of substances is prohibited except in accordance with the provisions of this annex. And ask to treat the empty packages used for carriage of harmful substances themselves as harmful substances unless adequate precautions have been taken to ensure that they contain no residue that is harmful to the marine environment. Further states that the provisions of this annex do not apply to ship’s stores.

2.       Packing

Regulation 2 requires the packages to be adequate to minimize the hazard to the marine environment.

3.       Marking and labelling

Regulation 3 requires the packages to be marked with correct technical names and marked or labelled to identify the substance is a marine pollutant. Trade names alone shall not be used. The regulation requires the durability of marking to be such that it survives minimum three months immersion in sea.

4.       Documentation

Documentation of harmful substances shall contain correct technical names and the words “MARINE POLLUTANT”. Each ship carrying harmful substances shall carry a special list of manifest identifying the goods and its stowage locations thereof. This list must be revised at any port where loading and or discharging of harmful substances takes place.

5.       Stowage

Harmful substances are to be stowed on board vessels in such a way to minimize the hazard to the marine environment without jeopardizing safety of the persons on board or ship.

6.       Quantity limitations

Certain harmful substances may need to be prohibited for carriage or limited by quantity which may be carried aboard any one ship. In limiting the quantity  consideration shall be given to size, construction and equipment of the ship, as well as the packaging and the inherent nature of the substances.

7.       Exceptions

Jettisoning of harmful substances are prohibited except when it is needed to secure the safety of life on board vessels or for securing the safety of the vessel.

8.       Port State control on operational requirements

Under amendments to Codes mandatory under the SOLAS Convention below were accepted

• International Code of Safety for High-Speed Craft, 2000 (2000 HSC Code), relating to radiocommunication, on testing of satellite EPIRBs.

• International Code for Fire Safety Systems (FSS Code), relating to fixed foam fire extinguishing systems; and automatic sprinkler, fire detection and fire alarm systems.

International Maritime Dangerous Goods (IMDG) Code and supplements (amendment 36-12), including harmonization of the Code with the amendments to the UN Recommendations on the transport of dangerous goods, seventeenth revised edition. Amendment 36-12 will enter into force on 1 January 2014, but Contracting Governments may apply the aforementioned amendments in whole or in part on a voluntary basis from 1 January 2013.

These amendments will enter into force from 1st January 2014.

COMPETENT AUTHORITY – Approvals and Exemptions

IMDG Code defines competent authority as any body or authority designated or otherwise recognized as such for any purpose in connection with IMDG Code.  Role of competent authority comes in various scenarios two of which are Exemptions and Approvals.

Exemption

When IMDG Code requires a particular provision for transport of dangerous goods which must be complied with a competent authority can authorize another provision provided that such provision is at least as effective and safe as what is required by IMDG Code

Example exemptions granted from the provisions of the IMDG code with respect to mixed loading in containers, number of passengers on board ro-ro passenger shi9ps referred to in the stowage table, stowage and segregation, definition of low wave height area by Lithuanian Competent Authority.

When a competent authority brings out an exemption the recipient of the exemption must notify all other competent authorities concerned and acceptance of such an exemption by another competent authority is solely as per their discretion.

Competent authority who issues the exemption must

a)       send a copy of such exemption to the International Maritime Organization which shall bring it to the attention of the Contracting Parties to SOLAS and/or MARPOL, as appropriate, and

b)       if appropriate, take action to amend the IMDG Code to include the provisions covered by the exemption.

Period of validity for an exemption cannot be more than 5 years.

Copy of exemption shall be kept on board vessel when transporting a consignment under exemption.

Approvals

Approvals are issued by competent authority as required by IMDG Code in specific cases such as alternative packaging  or certificates for tanks or approval of segregation of away from substances which approvals shall be recognized

a)      by other contracting parties to SOLAS if they comply with the requirements of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended; and /or

b)      by other contracting parties to MARPOL if they comply with the requirements of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto (MARPOL 73/78, Annex III), as amended.
