IMDG Code 40-20 has added a new provision 5.5.4 Dangerous goods in equipment in use or intended for use during transport.

Some equipment such as data loggers and cargo tracking devices may be used during transport or may be intended for use during transport. When such equipment contains lithium batteries, fuel cell cartridges or any other dangerous goods and is attached to or placed in packages, overpacks, containers or in cargo load compartments they are not considered as dangerous goods provided:

  1. The equipment is in use or intended for use during transport
  2. The dangerous goods within, example lithium batteries or fuel cell cartridges must meet all the applicable provisions of IMDG Code including construction and testing.
  3. The equipment must be capable of withstanding shocks and loadings normally encountered during transport and must be safe for use in dangerous environments to which it may be exposed.
  4. Must be securely installed to the cargo transport unit and must be of a certified safe type (Refer to the Recommendations published by the International Electrotechnical Commission, in particular, to publication IEC 60079) for the dangerous goods that will be carried within the cargo transport unit.

If such equipment containing dangerous goods is transported as a cargo, then all provisions applicable in IMDG Code must be complied with.
